Terms, Conditions and Privacy

1. About the platform

Renta-En-Cancun.com ("the Platform", "we", "us") is an online service that allows property owners, agents, and other authorized people ("Listers") to publish rental listings in Cancun, and allows visitors and registered users ("Renters") to search for and contact them.

We are not a real estate agency, broker, landlord, property manager, or party to any rental agreement. We do not own, inspect, or manage the properties, do not collect rent or deposits, and do not guarantee that a listing is accurate, legal, available, or safe. Any agreement is directly between the Lister and the Renter.

Accounts can have up to 3 active listings at a time, at no cost. Some accounts may be allowed more. We may offer additional listing capacity or other paid features in the future; we will clearly disclose the price and terms before charging you.

2. Accepting these terms

By accessing the Platform, creating an account, publishing a listing, or contacting another user, you agree to these Terms and our Privacy Notice (Part B). If you do not agree, do not use the Platform.

If you use the Platform on behalf of a company or another person, you confirm that you have authority to accept these terms for them.

3. Eligibility and your account

You must be at least 18 years old and legally able to enter into contracts. You agree to provide accurate, complete, and current information, and to keep it updated.

You are responsible for your account and password. Do not share your credentials. Notify us immediately if you suspect unauthorized access. You are responsible for activity carried out through your account, except to the extent caused by our fault.

We may require email verification and may refuse, suspend, or close accounts as described below.

4. Listing rules for Listers

When you publish a listing, you represent and warrant that:

• You own the property or are legally authorized to advertise it (for example, as the owner's agent).
• The information is accurate and not misleading, including the location, rent, currency, deposit, availability date, minimum lease, included utilities, furnished status, pets, parking, and any restrictions.
• You will update or remove the listing when it is no longer available.
• You have the right to use all photos, videos, and other content you upload, and they show the actual property.
• You will not publish other people's personal data without their consent.
• The rental complies with applicable law, including property rules, condominium rules, permits, and tax obligations.
• You will not discriminate against any person or group in a way prohibited by law.
• You will not post duplicate, spam, or misleading listings, or listings for illegal or uninhabitable properties.

5. Acceptable use

You agree not to:

• Commit fraud, post fake listings, impersonate anyone, or request money before a Renter has verified the property and the Lister.
• Harass, threaten, defame, or discriminate against others.
• Publish hateful, violent, sexually explicit, or otherwise illegal content.
• Upload malware, scrape or copy the Platform, bypass security or moderation, or interfere with its operation.
• Use contact information from the Platform for unsolicited marketing.
• Violate any law or the rights of any person.

We may remove content, suspend or close accounts, and report suspected illegal activity to the authorities.

6. Our role, moderation, and Renters

We do not verify every listing or user. We may, but are not obligated to, review, edit, verify, refuse, or remove content; request proof of ownership; and suspend or terminate accounts. A listing's presence on the Platform is not an endorsement.

If you are a Renter, always verify the property, the Lister, and the ownership before sending any money. Visit the property or use a live video tour when possible. Do not send deposits or rent to someone you have not verified. Get a written agreement and receipts. We do not mediate disputes, guarantee refunds, or recover money.

If you believe a listing is fraudulent, illegal, or inaccurate, report it using the report button or contact us.

7. Contracts and electronic signatures

We may offer tools to create, share, and sign rental agreements electronically. We do not provide legal advice and do not guarantee that a contract is complete, valid, or enforceable. The parties are responsible for reviewing the contract, negotiating its terms, and complying with it.

By signing electronically, you agree to use electronic records and signatures and that your electronic signature may have the same legal effect as a handwritten one. Signed contracts and signatures are stored on the Platform and shared with the parties involved.

8. Your content and intellectual property

You keep ownership of the content you upload. By posting it, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, resize, and use your content to operate, promote, and improve the Platform (including in search results and social media). You confirm that you have the rights needed to grant this license and that your content does not infringe anyone else's rights.

The Platform's name, logo, design, software, and original content belong to us or our licensors. You may not copy, modify, or distribute them without permission, except for normal personal use of the Platform.

9. Third-party services

The Platform uses third-party services, such as hosting, email, analytics, CAPTCHA, and map tiles. Their own terms and privacy policies apply to their processing. We are not responsible for third-party websites or services linked from the Platform.

10. Disclaimers, liability, and indemnity

The Platform is provided "as is" and "as available". To the maximum extent permitted by law, we make no warranties about availability, accuracy, quality, legality, safety, or fitness for a particular purpose. We do not guarantee that the Platform will be uninterrupted, error-free, or free of harmful content.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. We are not liable for the conduct of users, the accuracy of listings, rental agreements, payments, or disputes between users.

Where liability cannot be excluded, our total liability for all claims relating to the Platform is limited to the greater of (a) the total amount you paid us in the 12 months before the claim, or (b) MXN 5,000. Nothing in these terms limits rights that cannot be waived under applicable law, including consumer rights.

You agree to defend, indemnify, and hold us harmless from claims, losses, and expenses (including reasonable legal fees) arising from your content, your listings, your breach of these terms, or your violation of law or third-party rights.

11. Suspension and termination

You may stop using the Platform at any time and ask us to close your account. We may suspend or terminate your access if you breach these terms, if we believe your use creates risk, or if required by law.

When your account is closed, your listings will be removed, but some information may remain in backups or be retained as required by law. Sections that by their nature should survive — including intellectual property, disclaimers, liability, and indemnity — will survive termination.

12. Changes to these terms

We may update these terms from time to time. We will post the new version and update the date at the top. For material changes, we will give reasonable notice by email or on the Platform. Continued use after the changes take effect means you accept them. If you do not agree, stop using the Platform.

13. Governing law, disputes, and contact

These terms are governed by the laws of Mexico and the state of Quintana Roo, without regard to conflict-of-law rules. The courts of Cancun, Quintana Roo, will have jurisdiction, unless applicable consumer law requires otherwise.

1. Who is responsible for your data

This notice is issued in accordance with Mexico's Federal Law on Protection of Personal Data Held by Private Parties (LFPDPPP).

Renta-En-Cancun.com, based in Cancun, Quintana Roo, Mexico, is responsible for the personal data described in this notice. You can contact us at legal@renta-en-cancun.com or through our contact form.

2. Data we collect

We collect the data you provide and some technical data generated when you use the Platform:

• Account data: name, email address, password (stored in hashed form), email verification status, preferred language, and WhatsApp number if you add one.
• Listing and property data: property details, location, rent, deposit, photos, features, and the contact details you choose to show.
• Communications: messages you send through contact forms, listing inquiries, reports, incidents, and collaborator invitations.
• Contract data: names, emails, signatures, and the contents of contracts you create or sign through the Platform.
• Technical data: IP address, device and browser information, language, pages visited, referring page, approximate location, and cookie or analytics identifiers.

We do not intentionally collect sensitive personal data. Please do not upload government IDs, bank details, or other sensitive information unless it is necessary for a specific feature. The Platform does not currently process payments or payment card data.

3. Why we use your data and our legal basis

We use your data to:

• Create and manage your account and verify your email.
• Publish and display your listings and let users contact you.
• Provide contract and electronic signature tools.
• Respond to messages, reports, and support requests.
• Detect and prevent fraud, abuse, and security incidents.
• Improve the Platform and understand how it is used.
• Send service notices and, where required, marketing communications with your consent.
• Comply with legal obligations and enforce our terms.

We process data based on your consent, the performance of our service to you, our legitimate interests in operating and protecting the Platform, and compliance with legal obligations. Where consent is required, you can withdraw it at any time.

4. Cookies and analytics

We use cookies and similar technologies for essential functions (such as keeping you logged in and remembering your language), security (such as Cloudflare Turnstile), and analytics (such as Google Analytics). We also use map tiles from CARTO/OpenStreetMap to display locations.

You can control or delete cookies in your browser. If you disable essential cookies, parts of the Platform may not work. Where required by law, we will ask for your consent before using non-essential cookies.

5. Who we share data with

We do not sell your personal data. We may share it with:

• Other users, when you publish a listing or contact them (including the contact details you choose to display).
• Service providers that help us run the Platform, such as hosting, email, analytics, CAPTCHA, and map providers, under appropriate confidentiality and data protection obligations.
• Authorities or other parties when required by law, or when necessary to protect our rights, safety, or the rights of others.
• A buyer or successor in the event of a merger, acquisition, or sale of assets, subject to this notice.

6. How long we keep data

We keep your data while your account is active and for as long as needed to provide the service, resolve disputes, and comply with legal obligations. When data is no longer needed, we delete it or anonymize it. Some data may remain in backups for a limited period.

7. Security

We use reasonable technical and organizational measures to protect your data, including HTTPS, access controls, and hashed passwords. No system is completely secure, so we cannot guarantee absolute security.

8. Your rights

You have the right to:

• Access your personal data and know how it is used.
• Correct inaccurate or incomplete data.
• Delete your data when it is no longer necessary or legally required.
• Object to or restrict certain processing.
• Withdraw your consent.
• Limit the use or disclosure of your data.

These are known as your ARCO rights. To exercise them, contact us at legal@renta-en-cancun.com or through the contact form. We will respond within the time required by applicable law. If you are not satisfied, you can contact the Mexican data protection authority (INAI) or the competent authority in your country.

Depending on where you live, you may have additional rights, such as data portability or the right to lodge a complaint with a local authority.

9. Children and international transfers

The Platform is not intended for people under 18. We do not knowingly collect data from children. If you believe a child has provided us with personal data, contact us and we will delete it.

Some of our service providers may process data outside Mexico, including in the United States. Where required, we rely on your consent or appropriate safeguards for these transfers.

10. Changes and contact

We may update this Privacy Notice. We will post the new version and update the date at the top. Material changes will be communicated by email or on the Platform.
